These Terms & Conditions apply to online music lessons and related services provided by Music With Kami.

By requesting, booking or purchasing a lesson or Monthly Membership, you agree to these Terms & Conditions.

Nothing in these Terms is intended to exclude or limit any statutory consumer rights that cannot legally be excluded or restricted.

 

1. About Music With Kami

Music With Kami provides personalised online music tuition in:

• Piano

• Singing

• Guitar

Lessons may be adapted to suit the student’s age, experience, ability, interests and goals.

Lessons may include learning songs, developing technique, preparing for exams or performances, songwriting, music theory, musicianship, confidence-building and general musical development.

There is no requirement to follow a fixed lesson structure unless a specific structure has been agreed for the student.

 

2. Trial lessons

New students may request one free 30-minute trial lesson.

The trial lesson is intended to allow the student and/or parent or guardian to meet Kami, discuss goals, ask questions and experience the lesson format before deciding whether to continue.

Each student is entitled to one free trial lesson.

A trial lesson does not create an obligation to purchase further lessons.

 

3. Lesson requests and booking

Lessons are requested rather than automatically confirmed.

Students or parents/guardians should provide their preferred lesson day and time. Music With Kami will confirm a suitable time based on availability.

Regular lesson times are subject to availability and may be changed if another suitable time can be agreed.

 

4. Monthly Membership

The Monthly Membership is designed for students who want a regular weekly lesson.

The membership is structured around 48 weekly private lessons over a 12-month period, with lessons normally taking place at the student’s regular scheduled time.

Monthly payments are spread across the 12-month membership period.

 

4.1 Teacher holidays

Music With Kami includes four scheduled teacher holiday weeks during the membership period.

These dates will be communicated to students with reasonable advance notice.

Students are not charged for lessons falling within these scheduled teacher holiday weeks.

 

4.2 Student holidays

Monthly students may take up to 6 additional holiday weeks during their 12-month membership.

Students may pause their subscription for these weeks and will not be charged for the lessons covered by the approved holiday pause.

These holiday weeks are optional. They are not additional lessons and do not create an entitlement to replacement lessons.

Where a student is away for one week but does not wish to use one of their holiday weeks, they may request to move the lesson to the week before or after their absence and have two lessons in one week, subject to availability.

 

5. Additional lessons

Monthly students may request additional lessons in addition to their regular lessons.

Where an additional lesson is agreed, it will normally be charged at the student’s regular Monthly-equivalent lesson rate rather than the PAYG rate.

Additional lessons are subject to availability.

 

6. Changes to lesson length

Students may request a change to their regular lesson length or request an individual longer lesson.

Any difference in price may be invoiced separately or added to the student’s next scheduled payment.

 

7. PAYG lessons

PAYG lessons are individual lessons booked without a regular weekly commitment.

PAYG lessons are subject to availability and may be requested in advance or on the day.

Students are encouraged to request PAYG lessons as far in advance as possible to increase the likelihood of receiving their preferred day and time.

PAYG lessons are charged at the current published PAYG rate.

 

8. Multi-service and multi-student discounts

Where a household purchases more than one service or enrols more than one student, Music With Kami may offer a discretionary multi-service or multi-student discount.

Any discount is agreed individually and is not guaranteed at a fixed rate.

Any agreed discount will be communicated to the customer before the relevant payment is made.

 

9. Cancellation and rescheduling by the student

Students should provide as much notice as possible when they need to cancel or reschedule a lesson.

Where at least 3 hours’ notice is provided before the scheduled lesson, Music With Kami will normally offer to reschedule the lesson, subject to availability.

Where less than 3 hours’ notice is provided, the lesson will normally be considered used and will not automatically be rescheduled.

Music With Kami may use discretion in exceptional circumstances, including genuine emergencies or serious unexpected illness.

This policy applies to both Monthly Membership and PAYG lessons, subject to any overriding statutory consumer rights.

 

10. Cancellation by Music With Kami

If Music With Kami needs to cancel a lesson, the lesson will normally be rescheduled at a mutually convenient time.

If rescheduling is not reasonably possible, the appropriate lesson value will be credited or refunded where applicable.

Scheduled teacher holidays are not charged to Monthly students.

 

11. Late arrival

Students are encouraged to join lessons on time.

Where a student arrives late, Music With Kami may continue the lesson beyond the scheduled end time where both parties have sufficient time available.

Where a student arrives up to 15 minutes late and the lesson cannot be extended on the same day, Music With Kami may make up the missed time during the student’s next lesson where reasonably possible.

Where a student arrives more than 15 minutes late, or where making up the missed time is not reasonably possible, the lesson will normally finish at the scheduled end time.

 

12. Technical problems

Online lessons depend on appropriate internet connections, hardware and software.

If a technical problem causes a substantial loss of lesson time, Music With Kami will make reasonable efforts to make up the lost time.

Where possible, the cause of the technical problem will be identified and addressed before the next lesson.

Students are responsible for having a suitable device, stable internet connection and appropriate equipment for their lessons.

 

13. Payments

Payments must be made using the payment method available through the Music With Kami booking or payment system.

Monthly Membership payments are recurring and are charged at the agreed monthly price.

PAYG lessons and additional services are charged at the applicable published or individually agreed rate.

Music With Kami may change its prices in the future. Existing students will be informed of any price changes in advance before the new price applies to them.

 

14. Failed payments

If a Monthly Membership payment is declined or otherwise fails, the payment system may automatically retry the payment.

The account holder will be notified of the failed payment.

The system may continue attempting to collect the payment on subsequent days until payment is successful.

Where payment remains outstanding, lessons may be paused until the account has been brought up to date.

 

15. Refunds

Music With Kami does not generally provide refunds for lessons that have been purchased or paid for except where:

• a refund is required by applicable law;

• a payment has been taken incorrectly or more than once;

• an administrative or technical error has resulted in an incorrect charge; or

• exceptional circumstances make a refund or alternative arrangement appropriate at Music With Kami’s discretion.

Examples of exceptional circumstances may include serious illness preventing a student from continuing lessons for the foreseeable future.

Refund requests will be considered individually.

Nothing in this section limits or excludes any statutory consumer rights.

 

16. Monthly Membership cancellation

Students who wish to end their Monthly Membership are asked to provide at least one month’s notice wherever possible.

Where a cancellation request is made during the student’s current membership month, Music With Kami will normally arrange for the membership to end from the following month where the appropriate notice has been provided.

Where applicable, the student may continue with their normal lessons during the relevant notice period.

Any statutory cancellation or withdrawal rights remain unaffected.

 

17. Online resources and sheet music

Monthly students receive access to the Music With Kami sheet music library as part of their membership.

PAYG students may access the library where they have purchased the applicable additional access.

Students may download and print resources from the library for their own personal use.

Resources must not be redistributed, resold, uploaded elsewhere, publicly shared or supplied to other students without permission.

Music With Kami retains applicable rights in resources created and supplied through the service. Where third-party copyrighted material is used, students must comply with the relevant copyright restrictions.

 

18. Music theory group class

The weekly music theory group class is an optional additional benefit of the Monthly Membership.

It is not counted as one of the student’s 48 private lessons.

If a Monthly student chooses not to attend a particular theory class, no replacement class, private lesson credit or refund will normally be provided.

PAYG students may purchase access to the theory class separately where this option is available.

 

19. Children and young students

Parents or guardians may book and manage lessons for students under 18.

Parents do not normally need to remain present during the lesson. Independent participation is encouraged where the child is comfortable, happy and able to focus.

Parents and guardians remain responsible for ensuring that:

• the child has appropriate supervision outside the lesson;

• the child has a suitable and safe environment for their lesson;

• the child has the required equipment; and

• the child is able to participate appropriately and independently.

Music With Kami may request parent or guardian involvement where reasonably necessary.

 

20. Safeguarding

Music With Kami takes the safety and wellbeing of students seriously.

Kami is DBS checked.

Any safeguarding concern will be handled appropriately and, where required, may be reported to a parent, guardian, safeguarding body or relevant authority in accordance with applicable requirements.

 

21. Recording, photographs and promotional material

Regular lessons are not currently recorded by Music With Kami.

Students may occasionally be invited to provide photographs, videos, testimonials or other material for use on the Music With Kami website, social media or other promotional channels.

Permission will be requested separately before a student’s photograph, video or identifiable testimonial is used publicly.

Students are not required to agree to promotional use in order to receive lessons.

For students under 18, permission must be obtained from an appropriate parent or guardian.

 

22. Communication

Students and parents/guardians are responsible for providing accurate contact details and checking important communications relating to lessons, payments, holidays and schedule changes.

Music With Kami will make reasonable efforts to communicate important changes in advance.

 

23. Changes to these Terms

Music With Kami may update these Terms & Conditions from time to time to reflect changes to the business, services, payment systems or applicable requirements.

Where a change materially affects an existing student’s agreement, reasonable notice will be provided.

 

24. Suspension or termination of services

Music With Kami may suspend or end access to lessons where:

• payments remain outstanding;

• a student or account holder repeatedly breaches these Terms;

• behaviour towards Kami or other students is abusive, threatening or inappropriate; or

• continuing the service would be unsafe, unlawful or otherwise unreasonable.

Where appropriate, Music With Kami will attempt to resolve issues before ending the service.

Outstanding payment obligations and applicable consumer rights remain unaffected.

 

25. Consumer rights and online contracts

These Terms are intended to operate alongside applicable consumer protection law.

Where a statutory consumer right applies, that right takes precedence over any conflicting provision in these Terms.

Where applicable to a distance contract for services, consumers may have a statutory withdrawal period. If the customer expressly requests that a service begins during that period, applicable rules may allow the customer to be charged proportionately for services already provided before withdrawal. The exact rights and requirements depend on the applicable law and the circumstances of the contract.
